Persons with disabilities are eligible for early retirement under certain conditions
Disabled people can retire early if they meet certain conditions. The specific conditions are as follows:
1. Retirement conditions
At present, my country’s regulations on early retirement for disabled people are mainly determined based on factors such as degree of disability, working years, and pension insurance payment years. It is mainly divided into the following two situations. One is the situation where the ability to work is completely lost due to illness or non-work-related disability, and the other is the situation where early retirement occurs in a special type of work and the degree of disability affects the ability to work in a special type of work.
2. Conditions for early retirement due to illness or non-work-related disability
Disability degree requirements
Complete loss of working ability as determined by the Municipal Labor Appraisal Committee. Generally speaking, the degree of disability needs to be such that it affects the ability to take care of basic daily life and prevents normal work. For example, severe physical disability, severe visual impairment, severe intellectual disability, etc. may be considered as complete loss of working ability in many cases.
The identification criteria will be different for different types of disabilities. For example, physical disability may be evaluated based on the degree of limb loss, limited joint movement, etc.; visual disability may be judged based on the degree of vision loss; and hearing disability may be determined based on the decibel level of hearing loss.
Age requirements
Men must be over 50 years old and women must be over 45 years old. This is the general age requirement, but in actual practice, it may be adjusted due to differences in regional policies or special circumstances.
Requirements for pension insurance payment years
The cumulative payment period for pension insurance must be 15 years or more. This is the basic condition to ensure that you can receive a pension after retirement. The pension insurance payment period includes the actual payment period and the deemed payment period. The deemed payment period means that before the implementation of the pension insurance system, an employee’s working years can be regarded as the payment period.
3. Early retirement for special types of work and the impact of disability
Requirements for years of employment in special types of work
Engaged in underground, high-altitude, high-temperature, particularly heavy physical labor or other work harmful to health, the cumulative working years must reach the specified number of years. Generally speaking, employees who have been engaged in special types of work for 8, 10 or 15 years may have different years of experience depending on the type of work. For example, those who have been engaged in underground work for more than 9 years, those who have been engaged in high-temperature work for more than 9 years, those who have been engaged in high-altitude and particularly heavy manual labor for more than 10 years, etc.
Determination of work affected by disability
Inability to continue working in special types of work due to disability. This requires a certificate issued by a relevant medical institution to prove that the degree of disability does affect the safety and feasibility of working in a special type of work. For example, disabled people with severe lumbar disc herniation and other low back diseases may not be able to continue to work in special types of work that involve heavy physical labor.
Age requirements
Men must be at least 55 years old and women must be at least 45 years old. Again, this is a general age requirement and may vary depending on regional policies.
4. Process
Application for labor ability appraisal
Disabled persons apply for labor ability appraisal to their unit or local labor and social security department. When applying, you need to submit relevant medical records, disability certificates and other materials.
The labor and social security department organizes the Municipal Labor Appraisal Committee to conduct appraisal. The identification process may include physical examination, expert review and other links.
Submit retirement application
Disabled persons who are identified as having completely lost the ability to work shall submit an early retirement application to the local social security agency by their employer or themselves. Application materials generally include retirement application form, labor ability appraisal conclusion, ID card, pension insurance payment voucher, etc.
Review and Approval
The social security agency will review the application materials, including whether the pension insurance payment years, age, degree of disability, etc. meet the conditions for early retirement.
After passing the review, it will be reported to the superior human resources and social security department for approval. After approval, you can go through the early retirement procedures and start receiving pensions.
5. Things to note
Policies may differ in different regions. Before handling early retirement procedures, disabled people should learn more about the specific local policies and procedures.
Work ability appraisal is a key link. People with disabilities should ensure that they provide true and accurate medical records and disability certificates so that the appraisal results are objective and fair.
In the case of early retirement for special types of work, it is necessary to keep relevant work certification materials, such as pay stubs, work certificates, special type of work operation certificates, etc., to prove the number of years of working in the special type of work.
